Terms of use

These terms apply to hpconsulting.pro and to HPC's online course, AI coach, member community and live sessions (together, "the services"), provided by Human Performance Consulting LLC ("HPC", "we", "us"). By using the services or buying a membership, you agree to these terms. If you don't agree, please don't use the services.

Training, not treatment

HPC provides education and coaching in resilience and performance. It is not medical care, mental-health treatment, therapy or emergency help, and it doesn't replace them. The AI coach is an AI system trained on Dr. Naggiar's teaching; it is not Dr. Naggiar and not a clinician, and it can make mistakes. If you are in crisis, call or text 988 (press 1 for the Military Crisis Line), or call 911.

Some training includes physical exercise. Check with your doctor before starting any exercise program, stop if you feel pain or discomfort, and train within your limits. You take part in physical activity at your own risk.

Your account

You must be 18 or older to buy a membership. Keep your login private and don't share your account. You're responsible for activity on your account. Tell us right away if you think someone else is using it.

Membership

• Portal is $20 a month. Portal + Live is $80 a month. What each plan includes is described on our membership page.
• Memberships are billed monthly through our community platform (Heartbeat) and its payment processor (Stripe), and renew automatically each month until you cancel.
• We may change prices or what a plan includes. We'll tell you before a price change takes effect, and you can cancel before it does.

Billing and cancelling

You can cancel any time from your account settings. Cancelling stops future charges. Payments already made are non-refundable, except where the law requires a refund.

Programs for organizations

If your department, agency or company provides your access, the agreement between HPC and your organization also applies. If it conflicts with these terms, that agreement controls.

Community rules

• Treat other members with respect. No harassment, hate, threats or sexual content.
• What members share in the community stays in the community. Don't copy or repost other members' posts outside it.
• No advertising or selling to other members without our permission.
• We may remove content or suspend accounts that break these rules.

Our content

The course, videos, tools, worksheets, weekly training, writing and other materials belong to HPC or our licensors. You may use them for your own personal training. You may not copy, share, resell or publish them, or share your login so others can use them, without our written permission.

Your content

You keep ownership of what you post. By posting in the community, you give HPC permission to host and display it to other members so the community works.

Other services

Parts of the services run on other companies' platforms, including Squarespace, Heartbeat, Stripe, Zapier and Anthropic. Their own terms also apply when you use them.

No guarantees

The services are provided "as is." We work hard to make them useful, but we don't promise any particular result. Testimonials describe individual experiences, and results vary from person to person.

Limits on our liability

To the fullest extent the law allows, HPC is not liable for indirect, incidental or consequential damages arising from your use of the services, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim.

Ending access

You can stop using the services at any time. We may suspend or end your access if you break these terms or misuse the services.

Governing law

These terms are governed by the laws of the State of Florida. Any dispute will be handled in the state or federal courts located in Bay County, Florida.

Changes to these terms

If we change these terms, we'll update the date at the top of this page. If the change is significant, we'll tell members by email. Continuing to use the services after a change means you accept the updated terms.
